§1 General
Mercedes-Benz Tech Innovation GmbH (hereinafter "Mercedes-Benz Tech Innovation") is pleased that you are interested in working with our company. We take the protection of your data seriously and would like to inform you at this point which of your personal data we process for which purposes, on what legal basis the data processing takes place, what rights you are entitled to and whom you can contact if you have any questions or complaints.

§4 types of data that are collected
Personal data are information from which we can establish a direct or indirect reference to your person, such as first and last name, gender, address, telephone number, date of birth or e-mail address.
We process personal data that we need for the procurement of goods, services and trades from external suppliers in accordance with the data protection regulations of the country in which the body responsible for data processing is located (Germany). Our data protection policy is also based on the data protection guidelines applicable to Mercedes-Benz Group AG.
The following personal data are processed by Mercedes-Benz Tech Innovation:
Contact details:
Supplier data that we need for identification and data of external workers that we also need to identify the person, to create a company ID and to assign / manage rights and assets (e.g. name, address, telephone number, email address and date of birth, information on skills and vocational training)
Contract data and related information:
Data that we need to create, process the contract (including digital signature "electronic signature" as well as associated protocols, tests and log files) and for archiving contracts and contract-relevant attachments (e.g. address, contact person including name, (e-mail) address, Telephone numbers, products / services / services, contract data, qualification data, official documents as well as approvals, permits, performance records, sub-suppliers, emergency personnel)
Payment Information:
Data that we need for invoice processing and payment processes (e.g. contact person including (e-mail) address, bank details, invoice details)
Information from public or external information sources, in particular to verify identity
Credit information:
Information from public or external sources of information, in particular to verify creditworthiness
Data in the context of service provision:
Data that are collected as part of the provision of services and may contain personal data (e.g. performance records, protocols, handovers, acceptances)
§5 Purpose of the personal data
Mercedes-Benz Tech Innovation purchases goods, services and trades from external suppliers. For this purpose, so-called supplier data is recorded.
These are processed for:
- the initiation of orders (e.g. selection of suppliers, requests for quotations, tenders),
- the commissioning of suppliers (e.g. drawing up a contract and / or ordering including digital signature "electronic signature"),
- the provision of services (e.g. delivery tracking / goods acceptance, proof of performance, acceptances, providing emergency personnel with assets / access rights),
- the fulfillment of contractual and legal obligations (e.g. invoice payment, provision of services, supplier reviews),
- as well as for the master data maintenance regarding the suppliers for new, current and future purchase cases.
Any further use of this data would only take place if and to the extent that this is necessary to fulfill a legal obligation and / or to safeguard legal claims
§6 legal basis for the use of your data
The processing of your data is based on one of the following legal bases:
1 Data processing for the purpose of fulfilling a contract or to carry out pre-contractual measures (Art. 6 Para. 1 lit. b GDPR):
Your personal data is processed for the purpose of implementing a contractual relationship.
2 Data processing based on your consent (Art. 6 Para. 1 lit. a GDPR):
Insofar as we have obtained your consent to the processing of personal data for certain purposes (e.g. submitting an offer), the processing on this basis is lawful. Consent given can be withdrawn at any time. This also applies to the revocation of declarations of consent that were given to us before the GDPR came into force on May 25, 2018. The revocation takes place for the future and does not affect the legality of the processing of personal data until the revocation.
3 Data processing based on legitimate interest (Art. 6 Para. 1 lit. f GDPR):
We process your data to protect our legitimate interests. This includes the use of your personal data, possibly also for purposes
- Assertion of legal claims and defense in the event of a legal dispute,
- Investigation or prevention of criminal offenses.
If we want to process your personal data for a purpose not mentioned here, we will inform you beforehand within the framework of the legal provisions.
§7 forwarding of your data to third parties
The data collected in the course of the procurement of goods, services and trades from external suppliers are generally not passed on to third parties. An exception to this is data that is required for ID, account and asset management as well as for the use of the digital signature "electronic signature" and must be made via the systems of Mercedes-Benz Group AG, or data that we as a company belonging to the group in the context of reporting obligations due to legal, corporate or contractual obligations within the group. Something else would only apply if and to the extent that this is necessary to fulfill a legal obligation and / or to safeguard legal claims.
§8 transfer of your data abroad
The personal data collected in connection with the procurement of goods, services and trades from external suppliers will not be transferred to third countries, but will only be processed in member states of the European Union.
§9 retention of data
The deletion of the supplier data takes place in the case of an offer / tender / supplier information without establishing a contractual relationship at the latest one year after the first unanswered supplier self-assessment or in the case of the deletion request by the supplier or the person concerned.
If a contractual relationship is established, the duration of data storage is ten years from the end of the contractual relationship. If this is not contrary to longer retention periods and obligations, this is followed by deletion
§10 Secure data transmission
We use suitable technical and organizational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
§11 rights of data subjects and right of appeal to a supervisory authority
You have the right to receive information about the data stored about you by Mercedes-Benz Tech Innovation free of charge. In addition, you have the right to:
- correction of incorrect data,
- restriction of processing,
- deletion,
- Objection to data processing
- and data portability.
Complaints against Mercedes-Benz Tech Innovation can be submitted to the supervisory authorities.
